1. Overview
Welcome to Yawn Dept. This store is operated by YAWN DEPT LTD, a company registered in the United Kingdom with company number 17497696, trading as Yawn Dept. The terms "we", "us" and "our" refer to YAWN DEPT LTD.
These Terms of Service govern your use of our website and your purchases from us, including coffee subscriptions where offered. Our store is powered by Shopify. We currently sell and ship to customers in the United States and Canada, subject to the delivery locations available at checkout.
Please read these Terms together with our Refund Policy, Shipping Policy and Privacy Policy. By placing an order, you agree to the purchase terms made available to you before checkout. Please save a copy for your records.
Nothing in these Terms removes or limits rights that cannot lawfully be excluded under applicable consumer protection laws. If a term conflicts with a mandatory right available to you, that right takes precedence. Our Privacy Policy explains how personal information is handled; agreeing to these Terms does not provide consent for every type of data processing or marketing.
2. Eligibility and accounts
To place an order, you must have reached the age of majority in your state, province or territory and have legal capacity to enter into a purchase contract.
You must provide accurate, current billing, delivery and contact information and be authorized to use your chosen payment method. Keep your account credentials secure and contact us promptly if you suspect unauthorized access. You are responsible for activity you authorize; these Terms do not make you automatically responsible for every unauthorized transaction.
You may not transfer or sell your account. Unless we agree otherwise, purchases are intended for personal or household use.
3. Coffee and product information
We aim to describe our coffee accurately, including the product type, quantity, roast, grind and any other options available. Please check your selection before ordering.
Coffee is a natural product, so its appearance and sensory characteristics may vary between batches. Tasting notes describe a sensory profile and are not an ingredient list unless expressly identified as ingredients. Check the product listing and packaging for ingredient, allergen, storage and preparation information.
Images are illustrative, and screens may display colors differently. Any variation must remain consistent with the product description and applicable legal standards. Your rights regarding unsafe, defective or misdescribed products are unaffected.
Where a product is described as roasted to order, roasting and preparation take place before shipment. Any preparation time stated for the order is separate from carrier transit time unless the delivery estimate expressly includes both.
We may change products, descriptions and availability for future purchases. Changes do not retrospectively alter an existing order, and we will not make a material substitution without your agreement.
4. Orders and acceptance
You will have an opportunity to review your order before submitting it. A purchase contract is formed when we send an order confirmation accepting your purchase, or earlier if required by applicable law. A separate payment authorization or acknowledgement that we received a request does not itself postpone or override contract formation required by law.
Before a contract is formed, we may decline an order for a lawful reason, such as failed payment, reasonably suspected fraud or an unsupported delivery destination. Once a contract exists, we will honor it and will not rely on a general discretion to cancel it.
If a problem prevents fulfillment, we will contact you promptly to explain the issue and the options available under applicable law. If an order is lawfully cancelled or cancellation is agreed with you, we will refund the amounts due within the legally required period. A refund does not remove any additional remedy the law gives you.
5. Prices, currency and payment
The currency, product price, applicable taxes, shipping charges and other amounts we will collect will be clearly disclosed before you place your order. Advertised prices will include mandatory fees where required by law.
The agreed price is the price shown when you complete checkout. Changes to prices or promotions apply to future purchases, subject to the subscription provisions below. We will not increase the price of an existing order without your agreement.
Where you may be responsible for import duties, taxes or customs-related charges not collected at checkout, we will explain that responsibility before purchase as required by law. These Terms do not authorize undisclosed charges. Your payment provider may apply its own currency conversion or international transaction fees.
By submitting payment details, you confirm you are authorized to use that payment method and authorize the disclosed charge. Payment processing is subject to applicable law and the payment provider's terms.
Promotions may have additional conditions disclosed with the offer. Those conditions govern the specific promotion, subject to mandatory consumer rights.
6. Subscriptions and recurring payments
If you choose a subscription, we will disclose the recurring price, billing and delivery frequency, renewal arrangements, any minimum commitment and cancellation conditions before you subscribe. Subscription charges require your express agreement. A one-time purchase does not enroll you in a subscription.
By expressly agreeing to a subscription, you authorize recurring charges to your selected payment method according to the disclosed schedule until the subscription ends or is cancelled.
You can cancel future renewals online through the subscription management facility made available with your account or subscription confirmation. You can also email help@yawndept.com for cancellation or assistance. We will provide a straightforward cancellation process and confirmation.
To prevent the next scheduled charge, cancel before that charge is processed. Cancellation stops future renewals. If a renewal has already been charged, contact us about cancelling or returning that order under Sections 7 and 8. Statutory cancellation and refund rights remain available.
We will give any legally required advance notices about renewals or changes to subscription prices or other material terms, provide an opportunity to cancel before a changed charge takes effect, and obtain further consent where required. We will not impose a new minimum commitment without your agreement.
7. Order changes and cancellations
If you need to change or cancel an order, email help@yawndept.com as soon as possible with your order number.
We will try to accommodate requests before roasting, packing or fulfillment begins. We may be unable to stop an order once preparation or shipping is underway. This operational limitation does not override any cancellation right provided by law, including rights relating to delayed shipment, missing disclosures or unauthorized charges.
Where you have a legal right to cancel, a request does not depend on our discretionary approval and may be made by any method the applicable law permits.
8. Returns, refunds and product issues
Our Refund Policy sets out the full return process. Under our voluntary policy, you have 30 days after delivery to request a return of eligible coffee that is unused, unopened and in its original packaging with all original seals intact. Proof of purchase is required.
Email help@yawndept.com before sending anything back. For a change-of-mind return, wait for approval and our return instructions. If approved, we will provide a return shipping label and the correct return destination. Unapproved change-of-mind returns are not accepted.
For food safety and quality reasons, opened or used coffee, or coffee with a broken seal, cannot be returned for a change of mind or personal taste preference. This does not prevent a claim concerning coffee that is unsafe, defective, damaged, incorrect or not as described, including an issue discovered after opening.
Contact us promptly about a product problem, including your order number, a description and photographs where reasonably available. We will arrange an appropriate remedy under applicable law and cover necessary return costs where a return is required because of our error or a product fault.
The 30-day voluntary return window, packaging conditions and approval process do not restrict mandatory consumer rights or longer legal claim periods. Refund timing is governed by our Refund Policy, except that any shorter statutory deadline takes precedence.
9. Shipping, delivery and missing parcels
Available destinations, shipping charges and relevant preparation and delivery estimates are explained before purchase and in our Shipping Policy. An estimate does not remove our obligation to meet binding delivery commitments or applicable law.
If we cannot ship within the stated shipping period, or within the period otherwise required by law, we will notify you promptly, explain any revised estimate and offer the legally required choice of agreeing to a delay or cancelling for a prompt refund. We will obtain consent to a delay where required.
Carrier disruption, customs processing and other events may affect delivery. We will provide reasonable assistance and updates; these events do not automatically remove cancellation, refund or other statutory rights.
For shipments arranged by us, we remain responsible for the goods until delivery to you or a person or delivery location you have authorized, subject to any greater protection provided by applicable law. Responsibility does not pass to you merely because the parcel has been handed to a carrier.
If a parcel is missing, damaged or incorrectly marked as delivered, email help@yawndept.com. We will investigate with the fulfillment provider or carrier and provide the remedy required by law. A carrier's delivery scan does not automatically determine the outcome of a disputed delivery.
Please check your shipping address carefully. If an address error requires reshipping, we will explain any reasonable additional cost before you agree to it. This does not limit rights arising from an error by us or our delivery providers.
10. Intellectual property
Our branding, website design and original website content belong to Yawn Dept or the relevant licensors. Shopify and third-party names and marks belong to their respective owners. Customer reviews remain owned by their authors, subject to Section 13.
You may browse our website and save or print product information, these Terms and your transaction records for personal use. Other copying or commercial use requires the relevant rights holder's permission, except where permitted by law. Nothing restricts lawful quotation, fair use, accessibility or other statutory exceptions.
11. Shopify and third-party services
Yawn Dept is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Yawn Dept. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Yawn Dept, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Yawn Dept.
The preceding paragraph applies only to the extent permitted by law. It does not exclude any liability or remedy that cannot lawfully be excluded, including any independent mandatory responsibility of Shopify. It does not reduce Yawn Dept's responsibilities as your seller.
Our website may offer optional third-party tools or links to external websites. Separate terms may apply to your use of those services. We do not control independently operated third-party websites, but remain responsible for our own legal obligations and for providers acting on our behalf where the law makes us responsible.
12. Privacy
Our Privacy Policy explains how we and our service providers collect, use, disclose and protect personal information, including processing in other countries and your privacy choices.
Shopify also processes information under its Consumer Privacy Policy. Required marketing or cookie consent will be requested separately; it is not inferred solely from acceptance of these Terms.
13. Reviews and feedback
You retain ownership of reviews, photographs and other content you submit. For content you submit for public display, you grant us a non-exclusive, royalty-free license to host, reproduce and display it, and to use it in connection with our store and genuine product promotion where lawful. Service providers may use it only as needed to support those activities. We will not edit a review to misrepresent your opinion.
You must have the necessary rights to submitted content and disclose any relevant incentive or relationship. Do not submit unlawful content, malicious code, another person's confidential information or content that infringes their rights.
We may moderate unlawful, fraudulent, irrelevant or otherwise legitimately objectionable content. We will not prohibit, penalize or suppress honest negative reviews merely because they are unfavorable. Private customer-service messages are not treated as permission to publish them for marketing.
14. Errors and corrections
We may correct inaccurate website information for future transactions. If an error affects your order, we will explain it and handle the matter in accordance with the contract and applicable law.
A pricing or availability error does not give us an unrestricted right to cancel a binding order, substitute goods or demand a higher price. In particular, any mandatory protections for customers in Quebec or another jurisdiction take precedence.
15. Acceptable use and automated access
You must not use our website to commit fraud, impersonate another person, infringe rights, distribute malware, send spam, unlawfully collect personal information, harass people or interfere with security or normal operation.
Automated tools and agents must have appropriate authorization, identify themselves where required and respect applicable access restrictions. They must not bypass security measures or continue access after it has been lawfully withdrawn. Nothing in this section restricts access or use protected by applicable law.
16. Suspension and termination
We may restrict an account or website access where reasonably necessary to address fraud, security risks, unlawful activity or a material breach of these Terms. We will give notice and an opportunity to resolve the issue where appropriate, except where immediate action is reasonably required.
Suspension or termination does not remove rights relating to existing orders, refunds, warranties, personal information or legal claims. We will not continue charging for a subscription we have terminated. Terms that reasonably need to survive, including accrued payment obligations and provisions protecting legal rights and intellectual property, remain effective.
17. Website availability and product warranties
We take reasonable care in operating the website but cannot promise uninterrupted or error-free access. Temporary interruptions may occur for maintenance or events outside our reasonable control.
Our products must meet the standards required by applicable law, including requirements relating to safety, quality and conformity with their description. We do not exclude statutory warranties or sell consumer products on terms that remove those protections.
Any limitation relating to website availability does not remove our obligations concerning paid orders or your statutory remedies.
18. Liability and responsibility for misuse
We are responsible for loss or damage for which applicable law makes us liable. Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, gross negligence or deliberate misconduct, defective products where liability is mandatory, or any other liability that cannot lawfully be excluded.
Where applicable law permits, we are not responsible for business losses arising from purchases made for personal or household use, or losses that are not reasonably foreseeable consequences of our breach. These qualifications do not apply where local consumer law prohibits them, including applicable Quebec protections.
You remain responsible under applicable law for your own fraud, intentional misuse or unlawful infringement of others' rights. These Terms do not impose a general obligation on consumers to defend or indemnify us or Shopify for ordinary use of the store, our own fault or a good-faith consumer complaint.
19. Governing law and disputes
Subject to the protections below, these Terms are governed by the laws of England and Wales.
If you are a consumer in the United States or Canada, this choice does not deprive you of mandatory protections available under the laws of your state, province or territory, or applicable federal law. Where applicable law requires a different governing law, that law applies.
Nothing requires you to bring a claim exclusively in England and Wales or prevents you from using a court, regulator, small-claims procedure or other remedy available under mandatory local law. These Terms do not require mandatory arbitration or waive any non-waivable right to participate in a class proceeding.
For help resolving a concern, email help@yawndept.com. Contacting us first is encouraged but is not a condition of exercising a legal right where the law provides otherwise.
20. General provisions
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Any interpretation or severance must respect mandatory consumer protections. A delay in enforcing a right does not automatically waive it.
These Terms, the policies incorporated above and the information and specific terms agreed at checkout form the agreement for your purchase. They do not exclude legally binding product statements, representations or rights that apply by law. If a specific agreed purchase term differs from a general term, the specific term governs, subject to mandatory law.
We may transfer our contractual rights and obligations as part of a lawful business transfer only where your rights are preserved. We will give any required notice and obtain consent where the law requires it. You may transfer rights where permitted by law or with our agreement.
21. Changes to these Terms
We may update these Terms for future use and purchases. We will publish the revised version and update the date above. Material changes to an existing subscription or ongoing agreement will be handled with any notice, consent and cancellation rights required by law.
Changes do not retrospectively alter completed purchases, existing orders or accrued rights. Continued browsing alone does not authorize a new recurring charge or waive a mandatory right.
